This User License Agreement (“Agreement”) is a legal agreement between You and Lost City Entertainment LLC, a Florida company, for the use of the YounBooks or YounMusic streaming music service (the “Service”).

BY DOWNLOADING, ACCESSING, OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, DO NOT DOWNLOAD, ACCESS, OR USE THE SERVICE.

1. Description of Service

The Service is a monthly subscription service which provides you with access to stream musicfrom Lost City Entertainment LLC's library of music. The Service is available via the Apple Store. Subscription fees are billed monthly in advance.

2. Your Responsibilities

You are responsible for all equipment and software necessary to access the Service, including but not limited to a compatible device, internet access, and applicable fees. You are also responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. Lost City Entertainment LLC is not liable for any losses caused by

unauthorized use of your account.

3. Fees and Payments

The Service is available for a monthly fee of $1.99. Fees are billed in advance and are non-refundable. Lost City Entertainment LLC reserves the right to change the fee for the Service at any time.

4. Termination

You may terminate your subscription at any time by canceling your subscription through the Apple Store. Lost City Entertainment LLC may terminate or suspend your subscription at any time, with or without cause or notice.

5. Copyright

Lost City Entertainment LLC reserves all intellectual property rights related to the Service and its content. You agree not to copy, modify, or distribute any of Lost City Entertainment LLC's intellectual property in any way.

6. Disclaimer of Warranty

LOST CITY ENTERTAINMENT LLC PROVIDES THE SERVICE ON AN “AS IS” BASIS, WITHOUT WARRANTY OF ANY KIND. LOST CITY ENTERTAINMENT LLC MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON INFRINGEMENT. LOST CITY ENTERTAINMENT LLC DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

7. Limitation of Liability

IN NO EVENT SHALL LOST CITY ENTERTAINMENT LLC BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OR INABILITY TO USE THE SERVICE, OR FOR ANY OTHER DAMAGES ARISING OUT OF OR RELATED TO THE USE OF THE SERVICE.

8. Venue and Jurisdiction Provisions.

In the event of any litigation between the Parties, the Parties agree that the sole and exclusive venue and jurisdiction for any such action shall be in the District of Florida. The Parties agree that the prior referenced courts shall have personal and exclusive jurisdiction over the Parties for any dispute arising out of this Agreement that is not covered by the arbitration provisions

set forth herein.

9. Binding Arbitration. Any controversy or claim arising out of, relating to, or connected with this Agreement, or the breach thereof, shall be resolved by binding arbitration in accordance with the International Chamber of Commerce Rules of Arbitration, and judgment confirming the award rendered by the arbitrator(s) may be entered in any court having jurisdiction. Any arbitration under this Agreement shall be administered in Manatee County. The arbitrator(s) shall have no authority to award punitive damages but may award equitable relief. The arbitrator(s) shall enforce the terms of this Agreement, and to the extent, it is necessary and appropriate to go outside the terms of the Agreement to reach a decision, the arbitrator(s) shall follow the applicable law.

10. In the event user files a lawsuit or arbitration, the user shall be responsible for all legal fees and costs incurred by both Parties.

11. Miscellaneous

This Agreement constitutes the entire agreement between You and Lost City Entertainment LLC with respect to the Service and supersedes all prior or contemporaneous agreements, proposals, or communications. This Agreement shall be governed by and construed in accordance with the laws of the state of Florida. If any part of this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, the remainder of this Agreement shall remain in full force and effect. By using the Service, You acknowledge that You have read and understand this Agreement and agree to be bound by its terms.

User Data Tracking Agreement

This agreement sets forth the terms and conditions under which Lost City Entertainment LLC (“Company” or “YounBooks”) collects, stores, and uses the user data collected through its monthly $1.99 streaming YounBooks or YounMusic music service (“Service”). By using the Service, the user agrees to the terms and conditions of this Agreement.

1. Purpose of Data Collection

The Company collects user data solely for the purpose of marketing and improving the Service. No personal data, such as names or addresses, will be collected. The data collected will only be used to understand the user’s preferences and habits, such as

listening history and favorite artists, in order to provide better recommendations and a more personalized experience for the user.

2. Use of Data

The Company will only use the data collected for the purpose of marketing and improving the Service. The data will not be shared with any third-party organizations or used for any other purposes.

3. User Control

The user may control their data by adjusting their preferences in their account settings or by contacting the Company’s customer support. The user may request to have their data deleted at any time by contacting the Company’s customer support.

4. Data Security

The Company takes the security of the user data very seriously and implements appropriate security measures to protect the data from unauthorized access, disclosure, or alteration.

5. Changes to Agreement

The Company may make changes to this Agreement from time to time. The user will be notified of any changes to the Agreement and must agree to the new terms before continuing to use the Service. By using the Service, the user agrees to the terms and conditions of this Agreement and the Company’s use of the user data as outlined above. If the user does not agree to the terms and

conditions of this Agreement, they should not use the Service.
